Contract: 3 months, can extend
Schedule: Flexible, approximately 3 – 5 days each week as needed
Format: 1 day/week in-office (600 Washington Street, Boston), other days remote as scheduled
Rate: 32-34.50/hr + Sick leave
Conduct professional, fair, and impartial hearings in accordance with all applicable laws, regulations, and procedures in such a manner so as to improve public confidence in the integrity of the hearing process and administration of veterans' benefits
- The Department of Veterans’ Services (DVS) is a state agency within the Executive Office of Health and Human Services (EOHHS). The mission of the Department is to be the primary advocate for all veterans in the Commonwealth and provide them with quality support services. To accomplish this, DVS administers an array of programs and services, such as needs-based benefits program (Chapter 115), coordinating with Veteran Service Officers located in every community in the Commonwealth, which provides direct financial assistance and annuity benefits to veterans and eligible next of kin, funding to organizations offering homelessness, transitional housing, and outreach to veterans, connections to Massachusetts Career Center veteran employment services, operating two Soldiers’ Homes and two state veterans' cemeteries, and employing two unique and mission-critical outreach teams: The SAVE Suicide Prevention Team, and Women Veterans’ Network.
- Recipients of veterans benefits whose benefits are terminated or changed are entitled to a fair and impartial hearing pursuant to 108 CMR 8.07. Hearings are conducted in accordance with the informal procedures outlined in M.G.L.A. 30A § 11. Hearings are recorded and evidence is submitted by both the recipient and the local Veterans Service Officer who is proposing the change or termination of benefits. Due to the increased demand following the COVID-19 pandemic, there is a backlog of pending decisions which require additional resources to ensure recipients receive a timely hearing decision.
- The Department of Veterans’ Services is seeking an individual to support the legal department in conducting fair hearings and reviewing the regulations governing the comprehensive state benefits.
- Main tasks:
o Conduct professional, fair, and impartial hearings in accordance with all applicable laws, regulations, and procedures in such a manner so as to improve public confidence in the integrity of the hearing process and administration of veterans' benefits
o Render timely written decisions based on relevant statutes, regulations, directives, policies, and standards. Decisions must be submitted to the DVS General Counsel, or his/her designee, at least three (3) business days before DVS is required to render a decision in accordance with applicable statutes, regulations and or policies.
o Provide administrative support to legal team during review and rewrite of regulations governing comprehensive benefits program.
o Review prior hearings which were audio recorded and work with legal team to draft hearing decisions.
Preferred qualifications
- Strong legal research and writing background
- Applicants should have at least (A) three years of full-time, or equivalent part-time, or equivalent part-time, experience in investigatory or law enforcement work, (B) any equivalent combination of the required experience and the substitutions below.
- An associate's or higher degree may be substituted for the required experience. Education toward such a degree will be prorated based on the proportion of the requirements completed.
